City of Aurora and Dominick's Flip-Flop on Pro-Life Supporters Use of Vacant Lot

Planned Parenthood's site is in green.
Dominick's parent company owns the vacant lot

(updated) At Tuesday's opening, just as Planned Parenthood was highlighting their strategic design that would enable their visitors to bypass any pro-life supporters who may have a different message, the pro-life supporters gathered across the private drive on the vacant lot, which is owned by a real estate subsidiary of Safeway, the corporate parent of Dominick's.

Planned Parenthood complained to city officials, who first made the mistake of saying this was a "gray area" and weren't sure (keep in mind the city's so-called corporation counsel doesn't know much about the law and has to research these things first).

The lot is private property and, legally, there is nothing that prevents anyone from using it as long as the property owner doesn't object. The City of Aurora now says as long as no public safety issue is created, they cannot intervene.

At first, Dominick's seemed to stay out of the issue by not taking sides, but now we learn one person from their Oak Brook office may be telling pro-life supporters there are "liability" issues with being on the vacant lot. We note several media trucks were parked on the same vacant lot on Tuesday.

Dominick's is under pressure from both sides, but like most things in life, don't make this complicated. It's a vacant lot in retail area intended to be accessible by the general public.

Watch Alayne Weingartz, Aurora's so-called corporation counsel, demonstrate her well-researched knowledge of the vacant lot on her visit to Ground Zero:

Meanwhile, pro-life supporters are holding a "Life Chain" at two locations in Aurora on Sunday from 2:30 to 3:30pm.

***UPDATE - Aurora situation sparks large turnout in Naperville as well (see Daily Herald story)

There is a pro-life rally at City Hall on Tuesday, October 9th, which will be at the same time as the police union picket and rally against Aurora Mayor Tom Weisner.

On October 20th, pro-life supporters are planning a massive rally at Ground Zero, the site of the Planned Parenthood clinic.

Last, but not least, here are the PDF's of the appeal filed with the City Clerk and Aurora's Zoning Board:

Good. Make the protestors move. Get your message out a new way. You stupid protestors think that the few women going into the clinic are happy and skipping in to get abortions, don't you think that they have struggled with their decision? Don't you think they don't want to have to deal with annoying, self-righteous people? Truely be Christian for once a pray for these people at CHURCH or YOUR HOME.

Anonymous said...

There are liability issues. They should not be on that lot.

Do you have any idea how many lives have been saved by people praying in front of a clinic? Even if it’s just one life, then isn’t it worth it. How much is your life worth? If you were that baby in your mother’s womb as she was walking into the clinic, wouldn’t you want to be saved? Now seriously, how bad is it to have a couple of people praying for you and your unborn baby? It’s not as if these people are spitting on you, tossing eggs, shooting pellet guns, or anything of the sort – just praying. Now really, how bad can that be?

We would be VERY happy to sign a waiver of liability!!!

One more thing...I think the real danger is to the pedestrians walking down the street near the entrance on Oakhurst. There are NO sidewalks, and due to the traffic coming in and out of PP, Dominick's would be more liable for the death of a pedestrian that some protesters, what, falling off of their chairs on the grass????

I think it's actually safer for everyone to have the protesters on the vacant lot area than the sidewalk and it's even better for the neighborhood.

I agree! The protesters arn't protesting the good people of Oakhurst, they are protesting PP!

One of the Seargants from the APD that really created confusion was Jim Boatman. Who is responsible for promoting him to Sgt? He and Groom are two promotions that were bad ideas.

Anonymous said...

I am pro-choice but let's be honest about this. If PP has a right to exist there, the protesters should be able to express their view and it's much safer and better for everyone to be on that lot and there's no harm or danger to anyone except that it messes up the strategy for PP. Big deal. Almost everyone in the region or nation knows about this clinic site so anyone who goes there should expect protesters.

The war is always taken to the front lines...Babies DO get saved by us being there...we have already had testimonies...and the girls THANK us for being there. We tend to think that it is worth our time to be there to save just one life. No, we don't think the girls are happy about their decision...we are there to offer them an alternative.

Anonymous said...

Dominicks should just stay out of the whole thing and let the protesters use the lot as long as they aren't doing anything dangerous.

Anonymous said...

It's much better for the community if the vacant lot is used. I know that's not what PP wants but these protesters are peaceful and I don't see the big deal.

Anonymous said...

I know....why don't we ask Eric Scheidler if we can rent the use of the lot? Not a bad idea huh? Tell me what you think. Sounds like a problem solver to me.

Watched OB's commercial during the Cubs game and it ROCKED! His theme of family, faith and freedom really resonated w/ me. Go Jim!

These anti-choice TERRORISTS should be ashamed of themselves. They need to GET LIVES and start acting like real Christians. Real Christians don't spend all their time harassing and threatening people.

May God have mercy on their souls.

These raging idiots have no right to use private property to act like assholes. They should stay off of private property and use the public way. Or, better yet, go become productive members of society. Maybe help the poor while they're at it. That will never happen as that requires hard work. These nutcases would rather stand on a street corner and whine all day.

Anonymous said...

Good issues raised. But it may be best for our cause if the lot is used legally. After all, we are suggesting PP is illegally occupying the building since they have no special use permit. Let us be associated with peaceful and legal activities. Kenny G

My my - what potty mouths we have (a-holes.) Does using labels like "terrorists" and "raging idiots" make thier acts any more wrong? Come on now, get real. A couple of people praying for mothers and babies some 15 feet away from where people drive into a parking lot, is that so bad? These people are NOT spitting on you, tossing eggs, shooting pellet guns, which those prayerful people have been a victim of. Considering that, tell me who are the real jerks out there?

Come on people - get a grip.

Who was threatening people?

Ohh, and by the way, part of being a Christian is bearing witness to Christ's teachings, WHICH includes telling people when they are wrong. How about you C&E Christians stop reading your Chicken Soup and other works of humans and let Scripture interpret Scripture. The Word of God is infallible, why not trust it?

As well, I quote:

"Let the little children come to me, and do not hinder them, for the kingdom of God belongs to such as these."

Our Lord said it plain. I'd call abortion a big hindrance

The day that pro life people stop their peaceful protests and prayer vigils in an attempt to save the lives of the tiny, innocent human beings who are slaughtered in the abortion mills, will be the day in which our country loses all hope.

These defenseless babies have no voice of their own. They have no brick buildings with bullet proof glass to hide behind.

They only have the love of their mothers to protect them and give them a chance at life.

What can be more frightening than a mother turning against her own flesh and blood, and allowing that child to be brutally tortured and murdered?
We all abhor child abuse, but so many accept the worse form of child abuse, which is abortion.

Any person with a heart and an ounce of moral conscious will continue to fight for the unborn.

Everyone has the right to life.

How pitifully sad it will be if Dominicks, denies people the opportunity and obligation to speak up for life.

Anonymous said...

The only way for Dominick's to stay out of it is for them to not let their land be used for any protests by anybody.

Why can't you just pray from home?

Abortion is death. Christ came to conquer death, and therefore abortion. "I have come that they may have life, and have it to the full" (John 10:10).

These our His words, and may He have mercy on those who go against these words.

To 11:19,
I think you have misinterpreted this scripture. In Matthew 6:1, Christ exhorts his people to devote themselves sincerely to good works; that is, to endeavor, with simplicity, to do what is right before God, and not before men.

In essence, the people praying out there are doing this for the mothers and the unborn and not for the cameras and publicity. I submit to you, that those who are out there praying on the front lines will be there long after the media has left this issue. Those praying are not doing this for themselves, or for man, but for the altruistic sense of decency toward every human life, that it will be cherished.

So if it is only about the praying, then why not do it at church or at home? You say they are not there for the cameras and publicity, but they seem to revel at it.

The praying is for the mothers and their unborn babies; to show them that they are loved by the Lord – that there is no need to feel ashamed – but rather honored. How can you effectively do that from home? Can you show the ones that you love, that you in fact love them, without ever seeing them – I think not!

Again, I submit to you, that those who are out there praying on the front lines will be there long after the media has left this issue.

Erik's job is on the job training handed down from Papa and funded by some anonymous big money. He got lucky with a controversy in his backyard to cut his teeth. The question is - who is the Big Money funding Erik?

Weingartz sounded OK to me.

That sounds to me like a show, not prayer. I pray a lot, and I believe in the power of prayer, but I do it at home or wherever I happen to be, not in a place nor in a manner which is intended for someone to see. Which brings me back to:

"Beware of practicing your righteousness before men to be noticed by them; otherwise you have no reward with your Father who is in heaven." -Matthew 6:1

Accountability, my friend! The abortionists, mill workers & their clientele have an accountability issue to deal with, with us being there!

447 pm maybe you can answer a question I have. Let us say I am a pregnant woman thinking about an abortion. I go to the clinic and I see your horrible signs and I change my mind. What does your organization do with the lady who changed her mind? Do they stay in contact with her for weeks? Do they give her a ride home and a kiss on the forehead? With all this rhetoric about saving lives on the Dominicks grass I really want to know who you are saving?

There are Alternatives to Abortion!
It's often difficult to know where to turn when you are pregnant and afraid.

Well-meaning friends and acquaintances may recommend abortion as the easiest solution to a difficult situation. Yet we at Priests For Life have received hundreds of calls from women who have made this choice and later regretted it.

A November 1994 Reader Digest article by Mary Cunningham Agee reported that 91% of women surveyed in post-abortion interviews stated that they would have carried their child to term if the support had been there. Items most frequently mentioned were help with medical bills, ability to continue in her career or education, and most importantly, understanding from family, friends, and the father of the child.

Priests for Life wants to do what we can to help connect you with the people and resources which can make the choice for life a practical one, as well as a loving one for you and your baby, regardless of your financial or social situation.

Accountability, my friend! The abortionists, mill workers & their clientele have an accountability issue to deal with, with us being there!

Sorry, "friend." The minute you do anything more than pray -- the minute you try to get in the way of anyone entering or leaving that clinic, then YOU are the one with the accountability issue. YOU are the one interfering with the right of a woman to receive health care, to which she is legally entitled in these, the United States of America.

If you want to live somewhere where abortion is banned, move to Nicaragua. While you are there, you can pray for the women who are dying in childbirth because it is illegal to abort their life-threatening pregnancies. Behold the dead innocent women, the very fruits of your labors.

Taken from “The Demographics of Abortion” by Jim Kessler, The Third Way Culture Project.

Part II: Why Do Women Have Abortions?

While there are many reasons and circumstances that may lead a woman or a couple to choose an abortion, the overwhelming fact is that when a pregnancy is unplanned, abortion is the likely outcome. Abortions based on rape, incest, life of the mother, or abnormality of the fetus are uncommon. Reducing the number of unwanted pregnancies by 10% would eliminate more abortions in three days than would banning late term abortions over the course of a full year.

Part II, Finding #1

Half of all pregnancies are unplanned; most unplanned pregnancies lead to abortion.

In America, nearly half of all pregnancies are accidental. When an unplanned pregnancy occurs, the most likely outcome is abortion.

• For every 100 pregnancies in America, 52 were planned and 48 were unplanned.

• Among the 48% of pregnancies that were unintended, the percentage of abortions to live births is 54% to 46%.

Part II, Finding #2

Very few abortions are performed because of fetal abnormalities, health of the mother, rape or incest.

Of the 1.3 million abortions in America each year, about 90,000 occur due to the health of the fetus, mother, or rape or incest.

• 3% cited fetal abnormalities

• 3% cited health

• 1% cited rape or incest

I agree, they (Safeway) should stay out of it. There should be NO ONE on any one else's private property. It is a ridiculous asumption that any one has the right to protest on some one else's property, vacant or not. This is common sense folks.

Dominick's has already alowed pro-lifers to use their lot to park, but I imagine that will end soon. Why should they get mixed up in this?

As a business owner, it was a stupid move to allow these people there to begin with... I am sure their stockholders have no desire to be affiliated with this childish feud that has been totally blown out of proportion.
