President Obama Issues Executive Orders on Pay Freeze, Lobbyist Rules and Freedom of Information | Will State and Local Government Do the Same?



President Barack Obama's first day was highlighted by a press conference where he announced a pay freeze for his aides that make in excess of $100,000, new rules on lobbyists, including a restriction on aides that leave public service and would be banned from lobbying the administration as long as Obama is President and a new policy toward information requests.

Now lets see them freeze the pay of BF. Frank, Chuckycheeze Shooomer and Cheat Dodd for wrecking our banking system. I doubt it.

Have any of you ever wondered where, how and why presidents can issue “Executive Orders”?

They were first used by Lincoln during the Civil War and they arise out of the war powers clause of the constitution and subsequent legislation regarding emergency powers. Keep in mind that Lincoln suspended habeas corpus and imprisoned over 13,000 people without charges or trial.

Executive Orders arise out of so called emergencies.

Would any of you be surprised (suspect all of you) if I told you that this country has been under continuous emergency since 1917? Yes it started in WW I and continued thereafter with economic emergencies and has continued ever since. Very few of these emergencies have been declared to be ended so they all hang around even today.

In addition the “Trading With The Enemy Act” of 1917 which excepted Americans was amended in 1933 to include Americans in the definition of enemies of the United States. Yes, the great FDR made all of us enemies.

Many of the Executive Orders have referenced the Trading With the Enemies Act as a basis for the authority to issue that order. Such orders have the effect of law without input from Congress. I ask you, how close is that to dictatorial style power?
